Regulamin sprzedaży biletów wstępu na imprezy masowe – prowadzonej przez PERFECT HOSPITALITY sp. z o.o. za pośrednictwem serwisu sprzedażowego wykorzystującego system Tpay
1. Postanowienia Ogólne
- Niniejszy Regulamin (dalej zwany „Regulaminem”) określa zasady sprzedaży Biletów za pośrednictwem serwisu sprzedażowego, dostępnego na stronie internetowej www.perfecthospitality.pl przez PERFECT HOSPITALITY Sp. z o.o. (02-654) przy ul. Wyględowskiej 10, lok. 23, wpisaną do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy dla m. st. Warszawy w Warszawie XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem 0001199411, posługującą się numerem NIP 5214136805 (dalej zwaną „Sprzedającym”).
- PERFECT HOSPITALITY sp. z o.o. (02-654) przy ul. Wyględowskiej 10, lok. 23, wpisaną do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy dla m. st. Warszawy w Warszawie XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem 0001199411, posługującą się numerem NIP 5214136805 zajmuje się organizacją stref Hospitality na obiektach stadionowych takich jak PGE Narodowy w Warszawie i Stadion Śląski w Chorzowie (dalej zwane „Obiekt”).
- Regulamin określa warunki zawarcia na odległość, przy użyciu środków komunikacji elektronicznej, tj. za pośrednictwem serwisu sprzedażowego, dostępnego na stronie internetowej www.perfecthospitality.pl, Umowy sprzedaży Biletów uprawniających do wstępu na wybrane imprezy masowe w rozumieniu postanowień przepisów Ustawy o bezpieczeństwie imprez masowych z dnia 20 marca 2009 r. (Dz.U.2019.2171 t.j. z dnia 2019.11.08), oraz tryb postępowania reklamacyjnego.
- Jednym z warunków zakupu Biletu za pośrednictwem serwisu sprzedażowego, dostępnego na stronie internetowej www.perfecthospitality.pl jest zapoznanie się oraz akceptacja (za pomocą zaznaczenia pola typu „checkbox” – ) treści postanowień niniejszego Regulaminu przez Użytkownika.
- Sprzedawcą oraz wystawcą Biletów jest PERFECT HOSPITALITY sp. z o.o. (02-654) przy ul. Wyględowskiej 10, lok. 23, wpisana do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy dla m. st. Warszawy w Warszawie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem 0001199411, posługująca się numerem NIP 5214136805.
- Sprzedaż Biletów dokonywana jest za pośrednictwem serwisu sprzedażowego, dostępnego na stronie internetowej www.perfecthospitality.pl z wykorzystaniem systemu zamawiania biletów na wydarzenia kulturalne/rozrywkowe „Tpay”.
2. Definicje
Terms used in these Terms and Conditions that are included in the text of this paragraph 2 entitled "Definitions" shall have the meaning ascribed to them below, unless the text of the Terms and Conditions expressly indicates a meaning different from the meaning ascribed to them below:
- Bilet (bilet wstępu) – oznacza potwierdzenie zawarcia Umowy sprzedaży przez Użytkownika ze Sprzedającym, uprawniające Użytkownika (z zastrzeżeniem zdania czwartego niniejszego punktu „a”) do udziału w konkretnej Imprezie. Bilet możliwy jest do nabycia za pośrednictwem serwisu sprzedażowego, dostępnego na stronie internetowej pod adresem www.pefectvip.pl. Bilet zakupiony poprzez serwis sprzedażowy, dostępny na stronie internetowej www.perfecthospitality.pl ma formę Biletu z kodem. W zależności od Imprezy, Bilet może stanowić bilet wstępu na Imprezę o charakterze imiennym, tj. dedykowany konkretnemu Użytkownikowi/osobie przez Użytkownika wskazanej w trakcie procesu zamawiania (bilet prezent), lub bilet wstępu dla okaziciela. Ilekroć w Regulaminie jest mowa o Bilecie w liczbie pojedynczej, należy to pojęcie odpowiednio stosować do liczby mnogiej i odwrotnie.
- Biuro Obsługi Klienta – oznacza jednostkę Sprzedającego, udzielającą informacji Użytkownikom. Kontakt z Biurem Obsługi Klienta jest możliwy za pośrednictwem poczty elektronicznej (e-mail) w Dni robocze od godziny 10:00 do godziny 18:00, pod adresem email: office@perfecthospitality.pl. Opłata za kontakt z Biurem Obsługi Klienta za pośrednictwem komunikacji elektronicznej (mailowej) jest zgodna z wybraną przez Użytkownika taryfą dostawcy usługi dostępu do Internetu, z którego korzysta Użytkownik.
- Proof of Purchase - means a Ticket, an email confirmation of payment of the Amount Due for the sale of a Ticket.
- Business day - means any calendar day except Saturdays, Sundays and public holidays.
- Invoice - means an invoice in electronic form, issued and sent upon the User's request - made during the Ticket ordering process - in PDF format to the User's address indicated as part of the Ticket purchase process.
- code - means an individual code that can be read by scanning devices.
- Impreza – oznacza wybrane widowisko kulturalne/rozrywkowe, które organizowane jest przez partnera Sprzedającego, na które Bilety są sprzedawane za pośrednictwem serwisu sprzedażowego wykorzystującego System, udostępnionego na stronie internetowej www.perfecthospitality.pl.
- Amount due - means the amount that the User should finally pay after concluding the Ticket Sales Contract with the Seller, i.e. after pressing the "Buy and pay" button. Thus, the aforementioned amount consists of the sum of prices of selected (purchased) Tickets. The User is informed about the final amount due before concluding the Ticket Sales Contract with the Seller, i.e. before pressing the "Buy and pay" button.
- Venue - means the place where a particular Event will take place.
- Sprzedający – oznacza spółkę PERFECT HOSPITALITY sp. z o.o. (02-654) przy ul. Wyględowskiej 10, lok. 23, wpisaną do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy dla m. st. Warszawy w Warszawie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem 0001199411, posługującą się numerem NIP 5214136805, prowadzącą proces sprzedaży biletów wstępu na wybrane Imprezy, za pośrednictwem serwisu sprzedażowego wykorzystującego System, udostępnionego na stronie internetowej www.perfecthospitality.pl.
- Terms and Conditions - means these Terms and Conditions for the sale of Tickets by the Seller.
- Event Regulations - means the regulations dedicated to a specific Event, established each time by the organiser of the Event.
- Payment Service - means the payment service provided and operated by the company under the name of Krajowy Integrator Płatności S.A., with its registered office in Poznań (61-818), ul. Św. Marcin 73/6, holding tax identification number (NIP) 7773061579, and statistical number (REGON) 300878437, entered in the register of entrepreneurs under KRS number 0000412357, held by the District Court Poznań - Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register.
- Strona Internetowa Sprzedającego – oznacza stronę internetową www.perfecthospitality.pl, do której uprawnionym i której operatorem jest Sprzedający i w ramach której jest udostępniony serwis sprzedażowy, za pośrednictwem którego jest prowadzona sprzedaż Biletów przy wykorzystaniu Systemu.
- System - means the computer system for selling Tickets, designed to support the sales service, made available by Krajowy Integrator Płatności S.A. with its seat in Poznań (61-818), at Św. Marcin 73/6, with Tax Identification Number (NIP) 7773061579 and National Official Business Register Number (REGON) 300878437, entered into the Register of Entrepreneurs under KRS 0000412357, held by the District Court Poznań - Nowe Miasto and Wilda in Poznań, 8th Economic Division of the National Court Register, and which is used by the Seller to carry out the process of selling Tickets using the sales website. The system enables the handling of the Ticket sale process as well as the process of potential refunds. The minimum technical requirements for using the System (as part of the sales service) are as follows: Internet access with a minimum speed of 1Mbit/s, a web browser (recommended: Google Chrome, Internet Explorer, Mozilla Firefox, Opera), an application to support Javascript and cookies, a program to support PDF files.
- User - means any person who initiates the process of purchasing a Ticket through a sales service using the System, made available on the Seller's Website.
- Venue Rules - means the document drawn up by the owner or manager of the Venue setting out the rules applicable to persons participating in an Event held at a particular Venue, available on either the Vendor's Website (active link to the Venue's website) or the Venue; this document may appear under a different name on the Venue's website. (as long as the rules apply)
3. Zasady Ogólne
- These Regulations specify the rules of selling Tickets using the System via the sales service available on the Seller's Website. The purchase of Tickets through the sales service available on the Seller's Website requires, first of all, the User's prior acceptance of these Regulations, which is expressed and confirmed by ticking the checkbox () next to "I have read and accept the Terms and Conditions of Ticket Sales by the Seller" and providing true data necessary to proceed with the transaction in accordance with the instructions on the sales service available on the Seller's Website.
- Each User, by initiating the process of placing an order on the sales service made available on the Seller's Website, accepts the obligation to read the content of these Regulations before making a purchase (concluding a Sales Contract) of a Ticket through this sales service.
- Every Event has its own Regulations, the provisions of which also apply to the Users/Ticket Holders participating in the Event. The Seller makes the Event's Regulations available to the User by placing a link (active link) to its content in the sales service available on the Seller's Website. The User accepts the Regulations of the Event during the process of ordering the Ticket by ticking the checkbox (), i.e. before pressing the "Buy and pay" button.
- The Seller shall make the Terms and Conditions of the Payment Service available to the User by placing a link (active link) to its content in the sales service made available on the Seller's Website. The User accepts the Terms and Conditions of the Payment Service during the Ticket ordering process by ticking the checkbox (), i.e. before pressing the "Buy and pay" button.
- The owner or manager of the Facility where the Event is to be held may specify the Rules for the use of the Facility. In such cases, they shall apply to Participants/Ticket Holders staying at the Facility. The Rules of Use of the Facility will be made available in the sales service provided on the Vendor's Website (active link to the Facility's website). The User accepts the Facility's Rules of Use during the Ticket ordering process by ticking a checkbox (), i.e. before pressing the "Buy and pay" button.
- The User may not post unlawful content on the website or in the System, including content that may violate moral norms or personal rights of other persons/entities, or undertake any actions modifying the functioning of the website, the System, the Vendor's Website or related devices or software, in particular actions that may cause disruption or damage to the website, the System, the Vendor's Website or related devices or software. The User is obliged to use the sales service using the System, made available via the Seller's Website, dedicated to selling Tickets, in a manner consistent with these Terms and Conditions and the provisions of applicable law. In the case of any of the above violations, the Seller has the right to withhold access to the sales service using the System to the User committing the violation.
- The Seller sells Tickets for selected Events. Information on the Events for which the User can purchase a Ticket using the sales service using the System provided on the Seller's Website can be found on the Seller's Website.
- The Seller may make available a map of the Facility in order to facilitate the User's selection of the type (category, if a division is provided for) of Ticket. The Seller stipulates that it is not possible to precisely map the structure of the Facility using the graphics made available at the sales site, and therefore the maps of the Facilities presented should be treated only as an auxiliary, simplified and illustrative plan. In the event of introducing - in the course of the sale of Tickets - any changes to the map of the Facility, including in particular changes in the location of sectors, the Seller shall immediately inform the Users affected by the changes.
- In particular, it is forbidden for the User to purchase Tickets using a false or someone else's name, to make payments for purchased Tickets using a false or someone else's credit/debit card, without the consent of the credit/debit card owner, to transfer payments from someone else's bank account, without the consent of its owner or in any other unlawful manner. Notwithstanding the foregoing, the User will be able - if the Seller provides for a specific Event named Tickets - to purchase on their own behalf a named Ticket for a third party, i.e. a named Ticket entitling a third party to participate in an Event (a gift ticket).
- In the case of a User who is a natural person, the purchase of a Ticket can only be made by a natural person who has full legal capacity.
- Any and all information, data and materials made available on the Seller's Website (including but not limited to names, logos, schedules of Events, and price lists, as well as the colour scheme and layout of the Website) are subject to intellectual property rights, in particular copyright of the Seller or the Seller's partners with whom the Seller has entered into appropriate agreements.
- The User may use the information and materials referred to in paragraph 11 above only within the limits of permitted private use, to the extent provided for by applicable law.
- The Ticket allows the number of persons indicated on the Ticket to enter the Event (if it is a Bearer Ticket) or the persons named on the Ticket (in the case of a named Ticket). If there is no information on the Bearer Ticket concerning the number of persons who may enter the Event, the Ticket entitles only one person to enter the Event. Each time the Ticket specifies the days of participation in the Event.
- The Ticket entitles the User to occupy the seat indicated on the Ticket, provided that the seat number is indicated on the Ticket. Indication of a seat should also be understood as a sector. The Seller reserves the right to change the place indicated on the Ticket to a different one, in the same price category or a higher one, both before and during the Event, if it is required by security reasons, public order protection or other justified circumstances, of which the User should be informed by a representative of the Event organiser's security service.
- The object of sale through the sales service using the System, made available on the Seller's Website, are Entrance Tickets to selected Mass Events within the meaning of the provisions of the Law on Security of Mass Events of 20 March 2009. (Journal of Laws 2019.2171 t.j. of 2019.11.08) - profiled by a specific genre of music (the main/distinctive feature of the Ticket destination service). The selection of artists engaged for stage performances at each Event is subordinated each time to the genre of music by which each Event is profiled, and this selection is secondary.
4. Rezerwacja i Zakup Biletu
- The conclusion of the Ticket sale Contract is preceded by the correct course of the order process, according to the instructions included in the sales service available on the Seller's Website, which consists of the stages indicated in point 2 of this paragraph, from "a" to "i" inclusive. The User enters (concludes) the Contract of Sale for a Ticket after pressing the "Buy and pay" button, which involves an obligation to pay the price of the ordered Ticket using one of the payment methods indicated on the sales service made available on the Seller's Website, after the User has initiated the process of ordering the Ticket.
- The process of purchasing a Ticket through a sales site using the System, consists of the following steps:
- choice of Event;
- selection of the type of Ticket and possibly the category of Ticket, if such additional distinction is provided, and the number of such Tickets;
- completing the fields dedicated to the data necessary to complete the order, in particular the data necessary for the electronic delivery of the Ticket;
- Acceptance of the terms and conditions of the Rules and Regulations, Event Regulations, Facility Rules (if applicable);
- selecting the payment method for the Ticket, and accepting the terms and conditions of the Payment Service;
- confirm your wish to complete your order (conclude a Sales Contract) by pressing the "Buy and pay" button;
- confirmation of the terms and conditions and the conclusion of the Ticket Sales Contract by the Seller by sending a message to the email address provided by the User during the ordering process;
- automatic redirection to the Payment Service in order to make payment of the Amount Due to the Seller under the conditions indicated in the Terms and Conditions of the Payment Service;
- Confirmation of payment of the Amount Due will be sent via the System as soon as the Seller has received information that the funds for the Amount Due have been credited to the Seller's account on the Payment Service by sending a message to the e-mail address indicated by the User during the ordering process.
- If the Seller's Terms and Conditions provide for the selection of specific categories of Tickets, the User, when ordering a Ticket, shall also select the category of Ticket. Depending on the provisions of the Seller's Regulations, the User may purchase a maximum number of Tickets. For a given Event, the Seller may introduce restrictions on the maximum number of Tickets purchased during one transaction (order), concluded through the sales service using the System, made available on the Seller's Website.
- The purchase of a Ticket as a result of pressing the "Buy and pay" button involves an obligation to pay the Seller the price for each Ticket sold to the User (Amount due).
- From the moment the User confirms the wish to execute the order (conclude the Sales Contract) by pressing the "I buy and pay" button, a 15-minute session dedicated to the Payment Service begins, during which, for the successful completion of the payment procedure, the User should pay the Receivable Amount via the Payment Service and the funds for the Receivable Amount paid by the User should be credited to the Seller's account maintained on the Payment Service. After this time, the session on the Payment Service will expire. The consequences of the expiry of the session on the Payment Service are set out in section 7 below.
- Confirmation of the User's accession (conclusion) to the Contract of Sale of a pre-ordered Ticket through a sales service using the System will be sent immediately to the e-mail address indicated by the User during the ordering process.
- Confirmation of payment of the Amount Due will be sent via the System immediately - after the Seller has received information that the funds for the Amount Due have been credited to the Seller's account held on the Payment Service - to the e-mail address indicated by the User during the order placement process. Information on non-payment of the Amount Due will be sent through the System:
- in the event that the funds for the Amount Due are not credited to the Seller's account with the Payment Service within the period specified in section 5 above.
In the event that the funds for the Amount Due are not credited to the Seller's account held at the Payment Service following the case described in point "a" above in this section, this shall be deemed a withdrawal by the User from the Ticket Sales Contract and the User's order shall be cancelled, of which the User shall be informed in the content of an e-mail message, sent automatically to the e-mail address indicated by the User during the ordering process, and in which the User shall be informed at the same time that the funds for the Amount Due are not credited to the Seller's account held at the Payment Service. The above withdrawal and cancellation of the order shall not entail any obligation to pay additional remuneration to the Seller, subject to the provisions of section 8 below. The decisive moment for the payment shall be the date of receipt by the Seller of the information that the payment has been made - the funds for the amount due have been credited to the Seller's account held at the Payment Service. If an order is cancelled in accordance with this clause, it is not possible to restore the reservation for which the order was cancelled, but only to place a new order (new reservation). In this case, the Seller does not guarantee that the previously booked Tickets will still be available.
- A payment credited after the expiry of the time limit indicated in section 5 above will be returned to the User's account from which it was made, at the User's expense, as indicated in the Payment Service regulations.
- Payment for a Ticket ordered through the sales service using the System, made available on the Seller's Website, will be possible only and exclusively through the forms of payment made available each time on the Payment Service, to which the User will be redirected each time by the System immediately after the User confirms his/her intention to complete the order by pressing the "Buy and pay" button.
- Sprzedający przewiduje następujące formy płatności Kwoty należności, oferowane za pośrednictwem Serwisu Płatności (zgodnie z regulaminem korzystania z Serwisu Płatności, dostępnym na stronie: www.perfecthospitality.pl tj. w formie:
- Szybkich przelewów.
All costs, if any, associated with making payments for the purchase of a Ticket, as provided for in this section of the Terms and Conditions, shall be borne by the User.
- The payment resulting from one Sales Contract should be made in one go, in full and include the price of all previously ordered Tickets. The amount due resulting from the order should be paid in full and booked on the Seller's account kept on the Payment Service within the time limit given to the User by the Seller each time in the confirmation of concluding the Contract referred to in item 6 above. Payment shall be understood as the moment when the funds for the Amount Due are credited (posted) to the Seller's account maintained on the Payment Service.
- Providing incorrect credit/payment card details and accepting/confirming your willingness to make a payment will result in a refusal to complete the transaction (payment of the Amount Due) on the Payment Service.
- Refusal to complete the transaction (payment of the Amount Due) on the Payment Service is tantamount to the User's withdrawal from the Ticket Sales Contract (order cancellation) and results in restarting the Ticket order procedure. The aforementioned withdrawal and cancellation of the order do not entail an obligation to pay additional remuneration to the Seller.
- The contract for the sale of a Ticket is concluded when the "Buy and pay" button is pressed on the Seller's Website made available to the User.
- The User is obliged to verify the information placed on the Ticket/confirmation of the Ticket Sales Contract with the data entered/selected during the ordering process and verified immediately prior to concluding the Ticket Sales Contract.
- The ability to purchase a Ticket applies to Events active on a sales site using the System.
- The prices indicated on the Seller's Website, on the Payment Service, in the confirmation of placing an order with the obligation to pay (confirmation of concluding the Contract of Sale for a Ticket, and the amounts possibly indicated on the blank Ticket) are gross amounts, including VAT calculated in accordance with the binding legal regulations.
5. Dostarczenie zakupionego Biletu
- Użytkownik otrzymuje Bilet w formie wydrukowanej (hard copy) za pośrednictwem poczty kurierskiej – na terenie RP, albo poczty tradycyjnej (list polecony) – poza teren RP. Bilet zostanie wysłany na jeden miesiąc przed datą Imprezy, której Bilet dotyczy, lub w innym terminie określonym dla konkretnej imprezy. Koszt wysyłki Biletu obciąża Użytkownika. Użytkownik może wybrać opcję odbioru osobistego w dniu Imprezy, której Bilet dotyczy.
- Realisation of the Ticket takes place by presenting the Ticket issued by the Seller to the ticket taker - who admits the participants of the Event to the Venue.
- The Ticket sent by the Seller to the User upon receipt of payment of the Amount Due by the Seller, entitles the User to attend the entire specific Event or the specific day(s) of the Event - depending on whether it is a Ticket entitling the User to attend one day of the Event, selected days of the Event, or the entire Event. The Ticket does not authorise participation in any Event other than the one to which it is dedicated, and outside the date of the Event indicated on the Ticket. The above also applies to taking a seat in the appropriate sector of an Event.
- In the event that the User leaves the Venue (Event) during the Event, the User shall, on returning to the Event, present the Ticket, or other identification issued in exchange for the Ticket originally presented, to the Ticketmaster in the manner indicated in section 3 of this paragraph, under penalty of forfeiting the right to participate in the remainder of the Event.
- A ticket purchased through the sales service provided on the Seller's Website cannot be collected in any other way than that described in section 1 of this paragraph.
6. Postanowienia dodatkowe
- If the User would like to obtain an invoice for the sale of the Ticket, they should request an invoice during the Ticket ordering process by selecting the "I'm ordering an invoice" option (a checkbox ()) and providing the required data, indicated in a dedicated form, made available to the User after selecting the above option. The invoice will be sent together with the Ticket once the funds for the Amount Due have been credited to the Seller's account held on the Payment Service.
- The Seller is entitled to cancel an order/ticket if:
- The User has made payment of the Amount Due using stolen credit/payment cards, means of access to the account, against the will of the authorised person;
- The user has issued the Ticket for resale;
- The ticket was purchased through a sales channel not authorised by the Seller;
- The Amount Due has not been paid within the time limit specified in §4.5 of the Terms and Conditions or the funds for payment of the Amount Due have not been credited within the aforementioned time limit and the Ticket has nevertheless been issued and sent to the Participant.
- In the cases indicated in section 2 - subsections "a" to "c" inclusive - the seller is entitled to report any incident to the competent law enforcement authorities.
- Pursuant to Article 38 point 12 of the Consumer Rights Act of 30 May 2014 (Journal of Laws 2019.134 i.e. of 2019.01.23), the User is not entitled to withdraw from the Ticket Sales Contract under the conditions indicated by the content of Chapter 4 of the aforementioned Act.
7. Odwołanie, zmiana czasu, miejsca Imprezy, kategorii Biletu, zwrot pieniędzy za Bilet
- The Ticket purchased in the way specified in the Regulations does not entitle the User to claim a refund or to exchange it for another one, except in case of cancellation of an Event, change of date or venue of an Event, or downgrading of a Ticket. In case of cancellation of an Event, change of date or place of an Event, or downgrading a Ticket, the User will have the possibility to request a refund in accordance with the provisions of this §7. A change of the date of an Event referred to in the first and second sentence of this section means only a change of more than 4 (hours) hours from the originally agreed date of the Event. A change of the venue of the Event, as referred to in sentences one and two in this section, shall only mean a relocation of the venue outside the county boundaries in relation to the originally agreed county in which the Event was to take place.
- In the event of cancellation, change of the programme, time or venue of an Event, reduction of the Ticket category, the Seller shall immediately inform the Users who purchased a Ticket for a given Event. Users will be informed of each of the above facts by posting the relevant information on the Seller's Website. In addition, Users who are affected by each change will receive information about each of the above facts to the e-mail address indicated by the User during the ordering process.
- W przypadku uzyskania informacji od Sprzedającego o zaistnieniu którejś z sytuacji, o których mowa w §7 punkcie 1 powyżej, za pośrednictwem kanałów komunikacji wskazanych w punkcie 2 powyżej w niniejszym paragrafie, w celu uzyskania zwrotu pieniędzy (Kwoty należności), Użytkownik zobowiązany jest do przesłania, w terminie 7 dni od dnia powzięcia informacji, na adres e-mail: office@perfecthospitality.pl, aktualnych danych do przelewu bankowego – jeżeli rachunek z którego została uiszczona Kwota należności został zamknięty, numery transakcji, oraz kopii oryginału Biletu, wraz z uzasadnieniem żądania zwrotu pieniędzy (Kwoty należności). W przypadku zagubienia Dowodu Zakupu Użytkownik zobowiązany jest do wypełnienia i przesłania do Sprzedającego oświadczenia o zagubieniu Dowodu Zakupu. Zwrot pieniędzy (Kwoty należności) oznacza anulowanie Biletu, równoznaczne z jego zwrotem przez Użytkownika Sprzedającemu.
- Refunds of the Amount Due shall be made by bank transfer or by refund to a credit/payment card immediately - via the Payment Service - but no later than 14 (fourteen) days from the date of receipt of all data referred to in this paragraph, depending on the method of payment, whereby the User may indicate in the refund request the bank account to which he or she would like to be refunded - if the account from which the Amount Due was paid has been closed.
- In the event of an unjustified refund request for a returned Ticket, the User will be informed by the Seller of the reasons for not granting the refund request.
8. Procedura reklamacyjna
- All complaints should be reported by the User to the Customer Service Office by mail to the address: Warsaw, ul. Wyględowska 10/ 23, (02-654). Complaints shall be considered within 30 (thirty) days from the date of their receipt.
- Only complaints submitted in the Polish language will be considered. Only users have the right to lodge complaints.
- The complaint notification should contain the following information:
- User's name;
- the User's mailing address;
- the User's e-mail address;
- the subject of the complaint;
- a precise description of the advertised service;
- the reason for the complaint;
- Ticket and transaction number.
- Complaints containing incorrect or incomplete data as indicated in point 3 above in this paragraph, as well as complaints containing uncensual or abusive language will not be considered.
- The person making the complaint will be informed of how the complaint will be dealt with in the manner in which the complaint was made or by e-mail to the User's e-mail address provided during the ordering process.
- In the event that the delivered Ticket does not conform to the Sales Contract, the User should immediately notify the Seller, in accordance with the procedure provided for in section 1 above. In the event of receiving such a complaint, the Seller shall contact the User each time in order to clarify the extent of the non-conformity and to determine the terms of delivery of a new, conforming Ticket to the User's order. The method of contact depends on the time remaining until the start of the Event.
9. Odpowiedzialność
- The Seller is responsible for the correct operation of the sales service and the System used by the sales service. The Seller is responsible for selling the Ticket to the User in accordance with the terms and conditions chosen by the User during the ordering process. The User should report to the Seller any irregularities in the functioning of the sales service and the System used by that service.
- In the event of the cancellation of an Event, change of date or venue within the meaning of the Terms and Conditions, downgrading of a Ticket, the Seller shall be obliged to refund the amount due for the Tickets to Users, in accordance with the provisions of §7 above, on each call for a refund made in accordance with §7 above.
- The Seller is not responsible for the functioning of mobile phone networks through which Tickets are ordered. The Seller is not responsible for the individual settings of mobile phones, other mobile devices and the way they are configured, as well as the settings of mobile network operators and other Internet access providers.
- The Seller is not responsible for the functioning of the Internet network through which Users place orders. The Seller is not responsible for messages, confirmations and other data lost or misplaced on the Internet, individual computer settings and the way in which they are configured/derived/peripheral devices, as well as settings or service interruptions occurring at Internet access providers.
- The Seller is not responsible for sending a Ticket or a message with information regarding the Ticket sale process, the Event itself, to the wrong address if the data was incorrectly provided by the User.
- The User shall be liable for using the sales service made available on the Seller's Website and the System used by this service in a manner contrary to the provisions of these Terms and Conditions or the law, as well as for any damage caused by such acts/ omissions.
- In the case of registered Tickets, the Seller reserves the right to verify the data contained on the registered Ticket, purchased through the sales service using the System made available on the Seller's Website, with the data of the Ticket's disposer in the context of checking their conformity. The Seller reserves that if there is any doubt that the data of the Ticket holder does not match the data on the Ticket, they have the right to request the Ticket holder to present a different ID in order to verify the data other than the one originally provided for identification. The Seller reserves the right, if it turns out that the data on the Ticket differs from the data of the Ticket holder, to refuse to admit such person to the Event for which the Ticket was purchased, presented to the Ticket holder for verification.
10. Ochrona danych osobowych
- The administrator of the personal data provided by the User during the ordering process via the sales service is the Seller.

- Krajowy Integrator Płatności S.A., with its registered office in Poznań (61-818), Św. Marcin 73/6, Tax Identification Number (NIP) 7773061579, and Business Identification Number (REGON) 300878437, entered in the Register of Entrepreneurs under KRS No. 0000412357, held by the District Court Poznań - Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, is the Administrator of the personal data provided by the User in the process of making payments via the Payment Service.
11. Inne postanowienia
- In matters not covered by these Rules, the relevant provisions of generally applicable law will apply.
- These Terms and Conditions are available to Users at the Seller's registered office and on the Seller's Website in a manner that allows for their storage and reproduction in the ordinary course of business.
- In the event of disputes with the User, the court of jurisdiction shall be the court with jurisdiction under the applicable legislation.
